President’s Message – March/April 2018

Greetings and Salutations, Members,

The Greater Bridgeport Bar Association was established by thirteen attorneys in 1880. It’s hard to imagine that the founders could have predicted how strong and diverse an association the GBBA has become 138 years later. The GBBA has evolved to become a positive force professionally and socially not only to its members, but to the local community as well.

While the profession of law often entails contentious battles in the courtroom, the GBBA strives to provide events that foster collegiality. For example, on February 27th, members of the Young Lawyers Committee gathered at Trattoria ‘A Vucchella in Bridgeport for authentic Italian cuisine and comradery. Despite the inclement weather, on March 8th, a wonderful winter social was had at Ralph-n-Rich’s Restaurant in Bridgeport where harried members gave over to the relaxed ambiance, tasty delectables, and, most importantly, welcoming of colleagues. On March 15th, college basketball enthusiasts discussed the rudiments of bracketology during a fun March Madness event at Tiago’s Restaurant, coordinated by Attorney Etan M. Hirsch and GBBA Executive Director Antoinette Manganello.
Expanding its reach into the community, the GBBA sponsored the third round of the Bridgeport Middle School and High School Parliamentary Debate League, held at the Geraldine Claytor Magnet Academy in Bridgeport on February 24th. On February 27th, volunteers from the Community Outreach Committee, Chaired by Attorney Kathleen M. Dunn, purchased, prepared, and served lunch to over 200 economically disadvantaged people. For professional development, the GBBA offers many seminars, committee meetings, and happenings throughout the year to enhance your practice and help you meet the minimum continuing legal education requirements. The GBBA is an official accredited service provider for New York and offers a variety of educational seminars conveniently located at the office of the GBBA.

There are many exciting upcoming events, and we invite you to mark your calendars for each of them. On May 1, 2018, the GBBA will host the annual Law Day celebration by awarding the three top essay contest winners with monetary prizes and a special breakfast ceremony at the GBBA offices. To kick off the celebration, the Honorable Barbara N. Bellis will preside over a debate by four students from the Parliamentary Debate League. Please consider attending the Law Day celebration at the bar offices to support the very enthusiastic and committed children. On Monday, June 18, 2018, the GBBA and its golf-outing partner, The Center for Family Justice, Inc., will get into the swing of things at the Annual Golf Classic—order your Big Bertha now!

Finally, the culmination of this year’s events, the Annual Dinner Meeting, will be held on Thursday, May 17, 2018 at the Tashua Knolls Restaurant in Trumbull. The Annual Dinner Committee is proud to announce that it has selected the well-deserved honorees for 2018, Attorneys Kathleen M. Dunn and James Timothy Shearin. A collection of records of the first 29 banquets (now deemed the Annual Dinner Meeting), published in the Records of the Bridgeport Bar Association 1880—1908, reveals the fundamental purpose for the event’s creation, namely, to promote an opportunity for its members to socialize and to advances the principles of the legal profession. As the founders recognized: “there should be at least one day in the year when lawyers could call a truce and smoke the pipe of peace, in the hope that we would all understand one another better and thereby insure a more friendly and kindly professional spirit.” Happily, the GBBA has expanded to give us so many more opportunities to meet and mingle with one another other than the single day set aside over one hundred years ago. We hope you’ll continue to take part in the Association and in this special tradition.

READ ALOUD DAY is going to be held on Thursday, October 22, 2009 from 9:00 a.m. to 10:00 a.m.

Anyone who would like to participate in this event, please contact Kathleen Dunn at as soon as possible as spaces are limited.

READ ALOUD DAY is when volunteers are given a beautiful hard covered book to read to a class (K-6) and then give to the class as a gift. The book will be provided by the sponsors of the event.  The purpose of the day is to promote literacy and to share the joy of reading with school children.

Selecting your Business Name

With the increased consideration of entrepreneurism by victims of the economic downturn, it is important before investing time and capital to first select an unencumbered business name. Early diligent review is advisable rather than later finding out that there’s an adversely held prior usage. Disputes tend to arise, consistent with Murphy’s Law, at an inopportune time.

At first glance, it may seem rather straight forward to simply check to see if the business name you select is available for usage in the state. Under federal trademark law, if a business entity is the first to use a particular name in connection with the commercial use of products or services in
a specific geographical area, then the name can continue to be used. This is the case assuming that no other similarly named business, products, or services have prior usage in the same industry and geographical area, even if there is no official name registration.

However, if a beginning entrepreneur anticipates or plans to expand beyond a local geographical area or onto the Internet, it is advisable to make sure that there are no other businesses commercializing in the U.S. the same goods or services in the same channel of commerce using your chosen name (or in fact any name that might be confusingly similar). It’s expedient to thoroughly check to see if anyone is providing similar, or identical, goods of services. If a business has a similar name but different goods or services, you will probably be safe. If a start-up business does plan to expand beyond a local region or into the Internet, consideration should be given to filing for a registered trademark, even if the application is an “intent to use” application prior to actual commercial sales.

It is not terribly complicated to do a thorough name search using the U.S. Patent and Trademark Office’s search engine on the PTO’s web site ( or a domain search site (i.e., or a name search firm. Comprehensive domestic name searches, including domain names, state and federal registers can be done typically for a cost of between $300 and $600. It is usually not necessary to initially consider international trademark searching unless and until business expands beyond the U.S. In overview, a modest amount of care taken to select a business name can prove to be cost effective to obviate the possibility of costly downstream name disputes.
